Kidnapping is defined as the taking of another person and carrying them away and/or detaining them. This is done by the use of force, coercion, or deceit. Kidnapping is a crime involving the person being taken either against their will, or against the will of the legal guardian or caretaker. Example: A woman being pulled into a car and kept in the offender’s home. Another example is a non-guardian parent may take their child out of state without the permission of the legal guardian. Because he/she is not the legal guardian, and they do not have permission of the legal guardian (i.e.-mother), this is kidnapping, even if the child went with the father/mother willingly.
