Substantive violations of probation occur when you commit new criminal offenses. Keep in mind, even if the new criminal charge is dismissed or you win at trial, the State can still attempt to “establish” the offense at a VOP hearing. Unlike a criminal trial, the burden of proof is a lesser standard of a “preponderance of the evidence” and also there is no right to a jury trial.

Technical Violation

A technical violation is any violation of either your general or special conditions of probation that you are currently on.

Examples of technical violations include:

  • Your failure to pay court costs or fines
  • You change your address without permission
  • You are late to a probation meeting
  • You miss a probation meeting
  • You fail to complete court-ordered classes, etc.
